- "Data Plan" means a prepaid mobile data package for a specified country or region, with a defined data allowance and validity period.

3. Service Description
Telcomia is a platform that enables travellers to compare, purchase, and activate prepaid eSIM data plans for international connectivity. We offer plans covering over 200 countries and territories.
Connectivity is provided through partner network operators with the appropriate licences. Telcomia acts as a platform facilitating the purchase and delivery of eSIM profiles from these connectivity providers.
Device requirements: You must have an eSIM-compatible and carrier-unlocked device. It is your responsibility to verify your device's compatibility before purchasing a plan. A list of compatible devices is available on our website.
Service limitations: Plans provide mobile data only (voice calls and SMS are not included unless explicitly stated). Network speeds depend on local network conditions and the connectivity provider. Coverage may vary by location within a country.
4. Purchase Process and Delivery
The purchase process follows these steps:
- Select your destination country or region and choose a data plan.
- Proceed to checkout and complete payment via our PCI-DSS certified payment processor.
- Upon successful payment, your eSIM profile is generated and delivered.
- You receive your eSIM via QR code in your account dashboard and by email with activation instructions.
Delivery timeframe: eSIM profiles are typically delivered instantly after payment confirmation. In exceptional cases, delivery may take up to 24 hours. If your eSIM has not been delivered within 24 hours, please contact us at support@telcomia.com.
Moment of delivery: Delivery is considered complete when the eSIM profile is made available for download in your account dashboard, regardless of whether you have installed or activated it on your device.
5. Pricing, Currency and Taxes
All prices on telcomia.com are displayed in US Dollars (USD) and Euros (EUR). The price shown at checkout is the final price you will pay.
For customers located in the European Union, Value Added Tax (VAT) is included in the displayed price in accordance with Directive 2011/83/EU. The applicable VAT rate corresponds to your country of residence.
There are no hidden fees, service charges, or additional costs beyond the price shown at checkout.
6. Right of Withdrawal
This is an important section — please read it carefully.
Under Directive 2011/83/EU on consumer rights, you generally have a right to withdraw from a distance contract within 14 calendar days without giving any reason.
However, under Article 16(m) of Directive 2011/83/EU, as amended by Directive (EU) 2019/2161 (in force since 28 May 2022), the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium if all three of the following conditions are met:
- You have given your prior express consent for the performance to begin during the withdrawal period;
- You have acknowledged that you will lose your right of withdrawal once the eSIM profile has been generated; and
- We have provided you with confirmation of the contract on a durable medium, including confirmation of your prior consent and acknowledgement under point (m) of Article 16.
How this applies to Telcomia: When you purchase an eSIM data plan, you will be asked during checkout to expressly consent to the immediate generation and delivery of your eSIM profile and to acknowledge the loss of your right of withdrawal. Once the eSIM profile has been generated, performance of the contract has begun and the right of withdrawal no longer applies.
This consent is recorded and confirmed in your order confirmation email, which serves as confirmation on a durable medium.
If you have not yet received your eSIM profile, or if the profile has not been generated, you retain your full right of withdrawal. See our Refund Policy for details.
Model withdrawal form: In accordance with Annex I of Directive 2011/83/EU, a model withdrawal form is available in our Refund Policy.
7. Refund Policy
A summary of our refund policy is provided below. For full details, please see our dedicated Refund Policy page.
- Before eSIM generation: Full refund available.
- eSIM generated but not activated: Evaluated on a case-by-case basis.
- eSIM activated and functioning: No refund, as the digital content has been delivered and used.
- Technical failure verified by our team: Full refund or replacement.
To request a refund, email support@telcomia.com with your order number and reason.
8. User Accounts
To purchase an eSIM plan, you must create an account on telcomia.com. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Each person may hold only one account. You must provide accurate and current information during registration.
Telcomia reserves the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or are inactive for an extended period, with prior notice where possible.
You may request the deletion of your account at any time by contacting support@telcomia.com. Account deletion is subject to legal retention obligations (see our Privacy Policy, Section 6).
9. Acceptable Use
By using the Service, you agree not to:
- Resell, redistribute, or commercially exploit data plans purchased through Telcomia;
- Use the Service for any unlawful, fraudulent, or harmful purpose;
- Attempt to reverse engineer, decompile, or interfere with the platform's technology;
- Share data connections in a manner that exceeds the fair use limits established by the connectivity provider;
- Use the Service in any way that disrupts or interferes with our systems or third-party networks.
Tethering and hotspot usage may be limited depending on the connectivity provider and the specific plan purchased. Any applicable restrictions are indicated in the plan description.
10. Intellectual Property
All content on telcomia.com — including text, graphics, logos, icons, images, software, and design — is the property of Telcomia OÜ or its licensors and is protected by applicable intellectual property laws.
Trademarks, logos, and service names of third-party network operators displayed on our platform belong to their respective owners and are used for identification purposes only.
You may not reproduce, distribute, modify, or create derivative works from any content on telcomia.com without our prior written consent.
11. Limitation of Liability
Telcomia does not guarantee specific network speeds, continuous coverage, or uninterrupted availability of mobile data. Connectivity quality depends on local network conditions and the infrastructure of our connectivity providers.
To the maximum extent permitted by applicable law, Telcomia's total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid for the specific data plan giving rise to the claim.
Telcomia shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity.
Important notice for EU consumers: Nothing in these Terms limits or excludes your mandatory consumer rights under the applicable legislation of your country of residence, including rights under Directive 2011/83/EU and Directive (EU) 2019/770 on digital content.
12. Force Majeure
Neither Telcomia nor you shall be liable for any failure or delay in performing obligations under these Terms where such failure or delay results from circumstances beyond reasonable control. This includes, but is not limited to: natural disasters, government actions or sanctions, network outages by connectivity providers, cyberattacks, pandemics, or any other events of force majeure.
13. Duration and Termination
The contractual relationship for each data plan begins at the moment of purchase and ends when:
- (a) the data allowance has been fully consumed;
- (b) the plan's validity period has expired; or
- (c) Telcomia suspends the service due to a breach of these Terms.
After termination, the eSIM profile may remain installed on your device but is no longer guaranteed to function. You may remove the eSIM profile from your device at any time through your device settings.
Your account on telcomia.com remains active independently of individual plan purchases, unless you request its deletion.
14. Indemnification
You agree to indemnify and hold harmless Telcomia OÜ, its directors, employees, and service providers from and against all losses, costs, claims, damages, and liabilities arising from: (a) your breach of these Terms; and/or (b) your misuse of the Service.
15. Assignment
Telcomia may assign, transfer, or subcontract the rights and obligations arising from this agreement to any successor entity or group company without your prior consent, provided that such assignment does not adversely affect your rights under these Terms.
You may not assign your rights or obligations under these Terms without our prior written consent.
16. Governing Language
These Terms are available in English and Spanish. In the event of any conflict or discrepancy between the two versions, the English version shall prevail. This is relevant as the governing law is that of Estonia and English is the standard language for international legal reference.
17. Modifications
Telcomia reserves the right to modify these Terms. We will notify you of any changes at least 30 days before they take effect, via email or a prominent notice on our website.
Continued use of the Service after the notification period constitutes acceptance of the modified Terms. For material changes that affect your rights or obligations, we will request your active acceptance.
Exceptions: changes made (a) exclusively for your benefit, (b) of a purely administrative nature, or (c) required by applicable law may take effect immediately.
18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising from or in connection with these Terms shall be subject to the jurisdiction of the courts of Harju County (Tallinn), Estonia.
Important notice for EU consumers: If you are a consumer resident in the European Union, you also benefit from the protection afforded to you by the mandatory provisions of the law of your country of residence, in accordance with Article 6(2) of Regulation (EC) No 593/2008 (Rome I).
19. Dispute Resolution
If you are a consumer in the European Union, you may submit a complaint through the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
